Terms & Conditions

Welcome to 122Nord. These Terms & Conditions govern the supply of CNC cutting, laser engraving, CAD design, prototyping, joinery, fabrication, and bespoke furniture services provided by 122Nord (“we”, “us”, or “our”). By requesting a quotation, accepting a quotation, placing an order, or engaging our services, you agree to these Terms & Conditions.
1. Quotes
- All quotations are valid for 30 days unless otherwise stated.
- Quotations are based on the information, specifications, quantities, and materials supplied by the customer.
- Changes to project specifications, materials, quantities, finishes, or design after a quotation has been issued may result in a revised quotation.
- Unless otherwise stated, quotations exclude freight, installation, and any additional work requested after acceptance.
2. Orders
An order is confirmed once:
- the quotation has been accepted;
- any required deposit has been received; and
- all required drawings, specifications, artwork, measurements, and material selections have been provided.
122Nord reserves the right to decline any project at its discretion.
3. Deposits
A deposit is required to confirm and secure your booking. No work will be scheduled, materials ordered, or production commenced until the required deposit has been received.
The deposit will be credited towards the final value of your project.
Non-Refundable Deposits
The deposit is generally non-refundable because it covers costs incurred in preparing your project, including but not limited to:
- consultation;
- design and CAD work;
- project planning;
- administration;
- material procurement;
- CNC programming and machine setup;
- subcontractor costs (where applicable); and
- other project preparation expenses.
By paying the deposit, you acknowledge and agree that:
- your booking is confirmed only once the required deposit has been received;
- the deposit is non-refundable if you cancel or postpone the project after work has commenced or materials have been purchased; and
- changes to the project scope, specifications, materials, or schedule may result in additional charges and revised completion timeframes.
Discretionary Refunds
Notwithstanding the above, 122Nord may, at its sole discretion, refund all or part of a deposit where:
- 122Nord decides not to proceed with the project;
- unforeseen or exceptional circumstances make it unreasonable or impractical for the project to continue; or
- 122Nord otherwise determines that a refund is appropriate.
Where a discretionary refund is approved, 122Nord may deduct any reasonable costs already incurred, including but not limited to:
- consultation;
- design work;
- administration;
- materials purchased;
- CNC programming;
- machining;
- subcontractor charges; and
- any other project-related expenses incurred before cancellation.
Nothing in these Terms limits or excludes any rights or remedies available under New Zealand consumer law.
4. Payment
- Unless otherwise agreed, the outstanding balance is payable upon completion and before collection or delivery.
- Ownership of goods remains with 122Nord until payment has been received in full.
- Late payments may incur interest and reasonable debt recovery costs where permitted by New Zealand law.
- All prices are quoted in New Zealand Dollars (NZD) unless otherwise stated.
5. Customer Information, Design Files & Artwork
Customers are responsible for ensuring that all supplied information is complete and accurate, including:
- measurements;
- CAD files;
- drawings;
- artwork;
- engraving files;
- material specifications; and
- production requirements.
122Nord is not responsible for:
- errors contained within customer-supplied files;
- incorrect measurements or specifications;
- spelling or grammatical errors in approved artwork;
- manufacturing issues resulting from inaccurate information; or
- delays caused by incomplete or revised information.
Design assistance can be provided upon request and may incur additional charges.
6. Design Approval
Where drawings, proofs, renderings or CAD files are provided, production will not commence until written approval has been received.
Once approval has been given, the customer accepts responsibility for:
- dimensions;
- spelling;
- layouts;
- materials;
- finishes;
- quantities; and
- all other approved specifications.
Changes requested after approval may incur additional costs and revised completion dates.
7. Design Responsibility
Unless expressly engaged by written agreement to provide engineering, structural, architectural, or regulatory compliance services, 122Nord manufactures products in accordance with customer-supplied drawings, specifications, and approved designs.
The customer is solely responsible for ensuring that the final design:
- is suitable for its intended purpose;
- complies with applicable New Zealand building, engineering, safety, and regulatory requirements; and
- is appropriate for the intended application and installation.
122Nord accepts no responsibility for defects, failures, losses, or damage resulting from customer-supplied designs or specifications.
8. Materials
Natural materials including timber, plywood, veneer, MDF, acrylic, laminates, composite panels, and other sheet products naturally vary in:
- colour;
- grain;
- texture;
- finish;
- density; and
- appearance.
These natural variations are not defects.
Material availability may change without notice. Where necessary, suitable alternatives may be recommended.
9. CNC Cutting & Laser Engraving
Due to the nature of CNC machining and laser engraving:
- machining marks may occur;
- cut edge quality varies between materials;
- engraving depth and colour may vary;
- machining tolerances vary depending on material and manufacturing process.
Unless otherwise agreed, normal industry manufacturing tolerances apply.
10. Customer-Supplied Materials
Where customers provide their own materials:
- machining is undertaken entirely at the customer’s risk;
- 122Nord cannot guarantee machining or engraving results;
- hidden defects, warping, contamination, voids or inconsistencies within customer materials remain the customer’s responsibility.
122Nord may refuse to machine any material considered unsuitable or unsafe.
11. Lead Times
Estimated completion dates are provided in good faith but are estimates only.
Completion may be affected by:
- supplier delays;
- material shortages;
- machinery breakdowns;
- design changes;
- freight delays;
- weather events; or
- circumstances beyond our reasonable control.
122Nord will endeavour to keep customers informed of significant delays.
12. Collection & Delivery
Risk passes to the customer upon collection or delivery.
Customers should inspect all products promptly and notify 122Nord within seven (7) days if they believe goods have been supplied incorrectly or are defective.
Delivery charges are additional unless otherwise agreed.
13. Intellectual Property & Project Photography
Unless otherwise agreed in writing:
- all CAD drawings;
- CNC programming;
- machining strategies;
- tooling methods;
- design concepts;
- production methods; and
- prototypes
created by 122Nord remain the intellectual property of 122Nord.
Customers retain ownership of artwork, logos, trademarks, and design files supplied by them.
Project Photography & Media Use
By accepting a quotation, placing an order, or engaging 122Nord to design, manufacture, fabricate, customise, machine, engrave, or install any product, you acknowledge and agree that 122Nord may photograph, video, scan, render, or otherwise capture media of the completed work and its manufacturing process.
Unless otherwise agreed in writing before production begins, you grant 122Nord a perpetual, worldwide, royalty-free, non-exclusive licence to use this media for legitimate business purposes, including:
- the 122Nord website and online portfolio;
- social media platforms;
- printed and digital marketing;
- brochures and catalogues;
- trade shows and exhibitions;
- industry awards;
- customer case studies;
- project showcases; and
- advertising campaigns.
This consent applies only to the products, projects, and workmanship created by 122Nord.
122Nord will not knowingly publish confidential drawings, commercially sensitive information, proprietary manufacturing details, trade secrets, or personal information without prior written consent.
If complete project confidentiality is required, this must be requested and agreed in writing before production commences.
14. Cancellations
If an order is cancelled after work has commenced, 122Nord may charge for work completed, including:
- consultation;
- design;
- programming;
- materials;
- machining;
- subcontractor costs; and
- administration.
Deposits will be treated in accordance with Section 3.
15. Consumer Guarantees
Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 where that Act applies.
Where goods or services are supplied for business purposes, both parties agree that the Consumer Guarantees Act 1993 does not apply to the extent permitted by New Zealand law.
16. Limitation of Liability
To the fullest extent permitted by law:
- 122Nord’s liability is limited to the value of the goods or services supplied.
- We are not liable for indirect, consequential, incidental, special, or economic losses including loss of profits, production delays, business interruption, or loss of opportunity.
- Customers are responsible for verifying that products are suitable for their intended use before installation or commercial production.
17. Privacy
122Nord collects personal information only as reasonably necessary to:
- prepare quotations;
- process orders;
- communicate with customers;
- maintain business records; and
- comply with legal obligations.
Personal information is handled in accordance with the Privacy Act 2020.
18. Governing Law
These Terms & Conditions are governed by the laws of New Zealand.
Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.
